Terms of Service

These Terms of Service ("Terms") govern your access to and use of TEKSBuilder(the "Service"), an AI tool that helps educators generate standards-aligned classroom resources. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Important: AI-generated content must be reviewed before use with students.

TEKSBuilderuses artificial intelligence to draft classroom materials. AI can and does make mistakes — it may produce content that is inaccurate, incomplete, biased, outdated, or not correctly aligned to a standard. You are solely responsible for reviewing, verifying, and editing every resource for accuracy and appropriateness before printing it, sharing it, or using it with students. Do not rely on generated content without independent review by a qualified educator.

Who may use the Service

You must be at least 18 years old and using TEKSBuilder in your capacity as an educator or education professional. TEKSBuilder is a tool for adults and is not directed to children. You are responsible for keeping your account credentials secure and for all activity under your account.

Your account

You agree to provide accurate information when you register and to keep it current. One account is for one person; do not share your login. Notify us promptly at support@teksbuilder.com if you believe your account has been used without your authorization.

Subscriptions, billing, and cancellation

  • TEKSBuilder offers a free tier and paid subscription plans. Paid plans are billed in advance through our payment processor, Stripe, and renew automatically each billing period until cancelled.
  • You can cancel at any time from your account settings. When you cancel, your paid access continues through the end of the current billing period and does not renew.
  • Except where required by law, payments are non-refundable, including for partial billing periods. We may change plan prices with reasonable advance notice; changes apply to the next billing period.

Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • resell, redistribute, or provide the Service to third parties as a competing offering, or share account access to circumvent plan limits;
  • scrape, copy, or bulk-export the Service, or attempt to access it by automated means other than features we provide;
  • interfere with, disrupt, or attempt to gain unauthorized access to the Service.

Your content and generated resources

You retain ownership of the inputs you provide (the grade, subject, standards, and options you enter). Subject to these Terms, you are free to use, edit, print, and distribute the resources you generate in your own classroom and instructional work. You are responsible for reviewing generated content for accuracy and appropriateness before using it with students.

AI-generated content, accuracy, and your responsibility to review

  • AI output is not guaranteed to be correct. All resources are generated by artificial intelligence and may contain errors, inaccuracies, omissions, fabricated facts or citations, bias, outdated information, or content that is not fully or correctly aligned to the TEKS, STAAR, or any other standard.
  • You must review before use. You are solely responsible for reviewing, fact-checking, and editing every generated resource for accuracy, quality, appropriateness for your students, and standards alignment before you print, distribute, display, or otherwise use it with or provide it to students, parents, colleagues, or administrators.
  • The Service is a drafting aid only.It is not a substitute for your professional judgment, your district's approved curriculum, or any legal, accessibility, or accommodation requirements applicable to your students.
  • No warranty of alignment. Standards alignment is best-effort and is not guaranteed. We do not warrant that any resource meets state, district, or campus requirements.
  • TEKSBuilder is not responsible or liable for any consequences arising from your use of, or reliance on, generated content, including any content used with students without your review.

Assumption of risk and release

You acknowledge that you understand the limitations of AI-generated content described above and that you use the Service and any generated materials at your own risk. To the fullest extent permitted by law, you release and hold harmless TEKSBuilder and Beast Creative Agency from any claims, losses, or damages arising out of or relating to generated content or your use of it, including content you did not review before use.

Not affiliated with the Texas Education Agency

TEKS and STAAR are programs of the Texas Education Agency (TEA). TEKSBuilder is an independent product and is not affiliated with, endorsed by, or sponsored by the TEA. References to TEKS, STAAR, or other state standards are for identification and alignment purposes only.

Our intellectual property

The Service, including its software, design, branding, and content we provide (excluding your inputs and generated resources), is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your requirements.

Limitation of liability

To the fullest extent permitted by law, TEKSBuilder and Beast Creative Agency will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

Indemnification

You agree to indemnify, defend, and hold harmless TEKSBuilder and Beast Creative Agency and their officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your use, distribution, printing, or display of any generated resource, including any content you provided to students without reviewing it; or (c) your violation of these Terms or of any applicable law.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that could cause harm. On termination, the provisions of these Terms that by their nature should survive will remain in effect.

Governing law

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Texas.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide reasonable notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
